Terms and Conditions

Sales terms governing the sale of XFlow State to consumers in the Czech Republic.

1. Seller

2. Scope

These terms govern the rights and obligations of the parties arising from a purchase contract concluded between the Seller and a consumer (the 'Buyer') via the website xflowstate.com.

The legal relationship is governed by Czech Act No. 89/2012 Coll. (Civil Code) and Act No. 634/1992 Coll. (Consumer Protection Act).

3. Order and conclusion of contract

The Buyer creates an order via the checkout form on the website. The order is binding when submitted.

The Seller confirms the order by email. The purchase contract is concluded upon delivery of the order confirmation to the Buyer.

The Buyer agrees to use means of distance communication when concluding the contract; costs (internet connection, phone calls) are borne by the Buyer at their standard rates.

4. Price and payment

Product prices listed on the website are final and include VAT (where applicable).

Payment method: cash on delivery (COD). The Buyer pays the carrier upon delivery.

An invoice (tax document) is included with the shipment or sent electronically.

5. Delivery

Goods are shipped via GLS (Vnitrostátní přeprava) within the Czech Republic.

Delivery typically takes 1–3 business days from order confirmation.

The risk of damage to the goods passes to the Buyer at the moment the goods are handed over.

Shipping is free of charge unless otherwise stated.

6. Right of withdrawal (consumer)

Pursuant to §1829 of the Czech Civil Code, the Buyer has the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.

To exercise this right, the Buyer notifies the Seller at support@xflowtrading.com and returns the goods at their own cost. The withdrawal is effective on the day the notice is sent.

The Seller refunds the price (including delivery costs at the cheapest rate offered) within 14 days of receiving the returned goods, by the same payment method or by bank transfer.

The Buyer is liable for any decrease in the value of the goods caused by handling other than what is necessary to verify their nature, characteristics, and functioning.

7. Defects and complaints

The Seller is liable that the goods are free of defects on receipt. The Buyer's rights from defective performance are governed by §2099 et seq. and §2165 et seq. of the Civil Code, and by our separate Complaints Procedure (Reklamační řád).

8. Out-of-court dispute resolution

Pursuant to §14 of Act No. 634/1992 Coll., the Buyer is entitled to out-of-court resolution of consumer disputes via the Czech Trade Inspection Authority (Česká obchodní inspekce). More information at https://adr.coi.cz.

9. Personal data

Processing of personal data is governed by our separate Privacy Policy.

10. Final provisions

These terms are valid from the date stated above. The Seller reserves the right to amend them; previously concluded contracts are governed by the version in effect at the time the contract was concluded.
